1. Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) for fraud. It is your responsibility to provide us with an email address which is not located at the domain(s) you are signing up under.

2. Content

These services may only be used for legally-permitted purposes. Disallowed content includes, but is not limited to:

• IRC Bots
• Warez Sites
• Pirated Software
• Hate sites
• Programs that allow the illegal use of computers or computerized systems
• Sites that promote, encourage, or assist in the violation of laws

3. Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. Any user who sends out spam will have his or her account terminated without notice.

We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at our sole discretion. We also reserve the right to make any such modifications in an emergency at our sole discretion.

We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of TechMaster Telecom.

4. Email

We provide email service as a value-added service for domain names that are hosted with us. Email service is provided as-is, without any warranty or uptime guarantee whatsoever. Your email will be available via POP3, IMAP, and webmail interfaces, unless otherwise stated.

5. Payment

You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that unless payment is provided before the due date, services will not be provided until a payment is made.

We reserve the right to change the monthly payment amount and any other charges at any time.

6.) Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on our servers.

7. Cancellation and Refunds

We reserve the right to cancel the account at any time. A valid reason will always be provided.

Customers may cancel at any time. We give  you an unconditional thirty (30) day money back guarantee. Refund requests after thirty (30) days will be refunded on a prorated basis of any unused time.

Only first-time accounts are eligible for a full refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund. The same applies if you open a second account with us in addition to your main account.

8. Resource Usage

Users may not:

• Use 75% or more of system resources for longer then 90 seconds. System resources are: percentage of CPU capacity and RAM usage
• Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
• Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
• Run any software that interfaces with an IRC (Internet Relay Chat) network.
• Run any gaming servers. Note that we allow websites about games, just not servers that allow multiplayer play.

9. Bandwidth Usage

Bandwidth on all accounts is "unmetered". Umetered bandwidth is not the same as unlimited bandwidth. Each domain receives 2 mb/s (2000 kb/s), burstable to 3 mb/s (3000 kb/s) for two seconds at a time. The number of incoming connections will not be limited.

10. Price Changes

The amount you pay for hosting may change from the date of purchase. We will notify you thirty (30) days in advance of such a change. We reserve the right to increase or decrease the amount of resources given to plans at any time.

11. Indemnification

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any  liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from TechMaster Telecom’s servers.

12. Disclaimer

We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.

13. Changes to the TOS

We reserve the right to revise our policies at any time with or without notice.

14. Non-action not a Waiver

If we do not take action against a breach of this agreement, this does not constitute a waiver to take action at a later time.

15. Severance

If any portion or portions of this agreement is/are found to be unenforceable, all enforceable portions shall remain in effect.

16. Choice of Law

This agreement shall be governed by the laws of the County of Henrico, the Commonwealth of Virginia, and the United States.

17. Force Majeure

You agree not to hold TechMaster Telecom responsible for any cessation, interruption or delay due to earthquake, flood, fire, storm, natural disaster, act of God, war, armed conflict, terrorist action, lockout, boycott, electrical outage, or other event out of the control of TechMaster Telecom.

We will not hold you responsible for the same reasons.

18. Sub-Accounts

If you request the creation of "sub-accounts" (other account names that link to your main account), both you and the user of the sub-account shall be responsible for all activies performed under the sub-account. The same applies if you allow someone else to access your account. All sub-accounts will share system resources with the main account.

19. Subject headings

Subject headings are for convenience only, and do not have any effect on this agreement.

20. Entire Agreement

This agreement (along with any agreements or documents referenced by this agreement) constitutes the entire agreement between the customer and TechMaster Telecom, and supercedes any previous agreements and understandings, whether oral, written, or implied.
